NOTICE: THESE TERMS CONTAIN A BINDING ARBITRATION PROVISION AND CLASS ACTION WAIVER. PLEASE REVIEW SECTION 11 CAREFULLY.

These Terms of Use (the "Terms") govern your access to and use of www.elevated.careers and any related webpages, accounts, products, services, quizzes, digital downloads, courses, coaching services, career resources, software, applications, tools, and other offerings provided by Elevated Careers, LLC ("Elevated Careers," "we," "us," or "our"). We refer to these collectively as the "Services."

Please read these Terms carefully. They affect your legal rights and obligations.

By accessing or using the Site or Services, purchasing a product or service, creating an account, submitting information through the Site, or clicking to accept or agree to these Terms, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, do not access or use the Services.

You must be at least eighteen (18) years old, or the age of legal majority in your jurisdiction if higher, to purchase or use the Services.


1. Acceptance of These Terms

Each time you access or use the Services, you agree to comply with these Terms and any additional terms presented in connection with a particular product, service, promotion, feature, or purchase ("Additional Terms").

Additional Terms may include product-specific payment terms, refund policies, installment-plan terms, course terms, coaching terms, or other conditions presented before purchase or use.

If Additional Terms conflict with these Terms regarding a particular product or service, the Additional Terms will control for that product or service to the extent of the conflict.

Our Privacy Policy is incorporated into these Terms by reference.


2. The Services

Elevated Careers provides career education, career exploration resources, digital products, courses, coaching, quizzes, job-search resources, professional-development materials, and related services.

Services may include, without limitation:

  • the What's Next? Career Quiz;

  • the Corporate Career Explorer;

  • the Elevated Career Change Accelerator;

  • downloadable workbooks, guides, templates, prompts, trackers, and other digital resources;

  • free career resources;

  • job listings and job-search resources;

  • newsletters and educational content;

  • 1:1 Strategy and Action Planning sessions;

  • resume, LinkedIn, career-positioning, or related professional-development resources;

  • the Corporate Ready Pipeline;

  • AI-assisted prompts, exercises, or workflows; and

  • other products or services that Elevated Careers may offer from time to time.

Elevated Careers may add, modify, replace, improve, suspend, or discontinue features or Services from time to time.

Changes to free Services may occur without notice.

If we make a material change to a paid Service that affects an existing customer's purchased access, we will handle that change in accordance with the applicable purchase terms and applicable law.

Lifetime Access

Where a product is expressly advertised as including "lifetime access," lifetime access means access for the commercial life of that product while Elevated Careers continues to maintain, host, or make the product available.

It does not guarantee that a particular platform, technology, feature, website, vendor, format, or version of the product will exist indefinitely.

Elevated Careers may update, reorganize, migrate, replace, or retire portions of a product as technology, business operations, or the product itself changes.

If Elevated Careers permanently discontinues a lifetime-access digital product, we will make reasonable efforts, when commercially and technically feasible, to provide affected customers with notice or an opportunity to retain downloadable materials associated with their purchase.


3. Product-Specific Terms

(a) One-Time Purchases and Digital Products

A one-time purchase is a purchase that does not automatically renew unless the checkout page expressly states otherwise.

Downloadable guides, workbooks, templates, reports, prompts, spreadsheets, and similar electronic resources are digital products.

Unless otherwise stated on the applicable sales or checkout page, one-time purchases of digital products are final and non-refundable once access to the digital product or download has been provided, except where a refund or cancellation right is required by applicable law.

You are responsible for reviewing the product description and purchase terms before completing your purchase.

(b) What's Next? Career Quiz

The What's Next? Career Quiz is an educational career-exploration tool.

Your quiz result is based on the answers you provide and is intended to identify patterns in your stated preferences, interests, working style, and career-exploration priorities.

Quiz results are not professional psychological assessments, vocational certifications, employment evaluations, diagnoses, guarantees of career compatibility, or determinations that a particular occupation is appropriate for you.

A quiz result should be treated as a starting point for exploration rather than a guarantee that you will enjoy, qualify for, obtain, or succeed in any particular role.

(c) Corporate Career Explorer and Other Career Exploration Products

The Corporate Career Explorer and similar resources are designed to help users investigate career possibilities.

These products may contain examples of career functions, job titles, responsibilities, transferable skills, research methods, exercises, AI prompts, or suggested areas for further exploration.

Examples are provided for educational purposes and are not exhaustive.

Job titles and responsibilities differ between employers. Qualifications, salaries, hiring practices, work arrangements, technology requirements, and available opportunities also change over time.

You are responsible for researching current opportunities and determining whether a particular career, company, role, application, or employment decision is appropriate for you.

(d) Career Change Accelerator

The Elevated Career Change Accelerator is an educational career-development program.

Additional terms may apply to the Career Change Accelerator and will be presented on the applicable sales, checkout, or program terms page.

Those Additional Terms are incorporated into these Terms for customers who purchase the Career Change Accelerator.

(e) Payment Plans

When Elevated Careers offers an installment payment plan, the payment plan allows you to divide the total purchase price into scheduled payments.

An installment payment plan is not a cancel-anytime subscription.

Unless the applicable product terms expressly state otherwise, selecting an installment plan creates an obligation to complete all scheduled payments for the product purchased, even if you stop using the product, subject to any cancellation or refund rights required by applicable law.

By choosing an installment plan, you authorize our payment processor to charge your selected payment method for each scheduled installment.

(f) Subscriptions

If Elevated Careers offers a product or service that automatically renews, the recurring price, billing frequency, renewal terms, and cancellation method will be disclosed before purchase.

Cancellation of a subscription stops future renewals as described in the applicable offer terms. Cancellation does not ordinarily create a refund for charges that have already occurred unless required by law or expressly provided in the applicable offer.

(g) 1:1 Strategy and Action Planning Sessions

By purchasing a 1:1 Strategy and Action Planning session, you agree to the following:

  1. Scope of Session. Unless otherwise stated on the booking page, each session is a one-time, 60-minute session focused on the career needs discussed during the appointment.

  2. Action Plan. Where included in the purchased service, you will receive a written action plan or recommendations following the session.

  3. Ongoing Support. A one-time session does not include unlimited follow-up support, ongoing document review, or continued coaching unless expressly stated in the offer.

  4. Scheduling. Sessions must be scheduled in accordance with the booking instructions provided after purchase.

  5. Rescheduling. Unless different terms are stated on the booking page, sessions may be rescheduled with at least 24 hours' notice.

  6. Late Cancellations and No-Shows. Unless required otherwise by law, sessions canceled with fewer than 24 hours' notice and missed appointments are non-refundable and may not be rescheduled without purchasing another session.

(h) Corporate Ready Pipeline

Participation in the Corporate Ready Pipeline is voluntary and requires affirmative opt-in.

By opting in, you acknowledge and agree that:

  1. Recruiter and Employer Visibility. Elevated Careers may share information you designate for the Pipeline with recruiters or employers seeking candidates whose backgrounds appear relevant to their hiring needs.

  2. No Guaranteed Placement. Participation does not guarantee recruiter contact, interviews, offers, employment, compensation, or any other hiring outcome.

  3. Hiring Decisions. Employers and recruiters make their own independent hiring decisions. Elevated Careers does not control those decisions.

  4. Accuracy. You are responsible for ensuring that information you provide, including your LinkedIn profile, resumes, employment history, preferences, qualifications, and professional materials, is accurate and current.

  5. Eligibility and Removal. Elevated Careers may decline, suspend, or remove a Pipeline profile if information is incomplete, inaccurate, misleading, inappropriate, or inconsistent with program requirements.

  6. Use of Information. Information provided through the Pipeline will be handled in accordance with our Privacy Policy and the consent provided when you opt in.


4. Accounts and Information You Provide

Certain Services may require you to create an account or provide information.

You agree to provide information that is accurate, current, and complete.

You are responsible for maintaining the confidentiality of any account credentials and for activity conducted through your account.

You may not share account credentials or permit another person to use a paid individual account unless Elevated Careers expressly authorizes such sharing.

If you believe your account or credentials have been compromised, contact us promptly.

Elevated Careers may suspend or terminate access to an account if we reasonably believe it has been used fraudulently, shared without authorization, compromised, or used in violation of these Terms.


5. User Content

"User Content" means information or materials you voluntarily provide to Elevated Careers through the Services. Examples may include career history, resume information, educational history, quiz responses, profile information, written responses, questions, uploaded documents, feedback, testimonials, professional materials, and other information you choose to provide.

You retain ownership of your User Content.

By submitting User Content, you grant Elevated Careers a non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, format, and use the User Content as reasonably necessary to:

  • provide the Services you request;

  • create materials or recommendations you request;

  • provide customer support;

  • operate and secure the Services;

  • fulfill purchases;

  • facilitate features in which you voluntarily participate;

  • comply with law; and

  • exercise rights expressly described in these Terms and our Privacy Policy.

This license does not give Elevated Careers ownership of your resume, career history, or other personal User Content.

We may use aggregated or de-identified information for analytics, research, product improvement, or business planning where that information does not reasonably identify you.

We will not publicly use your name, image, private career materials, or personal testimonial for marketing merely because you submitted them through a private Service. Public marketing use will require permission, a separate release, or circumstances in which you intentionally submitted the material for publication.

You represent that you have the right to provide any User Content you submit and that doing so does not violate another person's intellectual-property, confidentiality, privacy, contractual, or other rights.

Do not upload confidential information belonging to an employer or another third party unless you have permission to do so.


6. Payments

If you purchase a paid Service, you agree to pay the price, taxes, and other charges disclosed at checkout.

Payments may be processed by third-party payment providers.

By providing a payment method, you represent that you are authorized to use that payment method and authorize the applicable payment provider to process charges associated with your purchase.

For installment plans or recurring Services, you authorize scheduled charges in accordance with the payment terms presented before purchase.

If a scheduled payment fails, we may retry the payment, request an updated payment method, suspend access to the associated paid Service, or take other reasonable steps to collect amounts properly due.

You remain responsible for valid unpaid balances.

Prices may change for future purchases.

A price change will not retroactively alter the price of a completed one-time purchase.

For recurring Services, any price change will be handled in accordance with the terms disclosed for that Service and applicable law.

Unless otherwise stated, prices are quoted in U.S. dollars.

Your bank, card issuer, payment provider, or financial institution may impose foreign transaction, currency conversion, or other fees. Elevated Careers does not control those charges.


7. Cancellations and Refunds

Refund and cancellation rights depend on the type of Service purchased and any product-specific terms presented before purchase.

Digital Products

Unless otherwise stated at checkout, sales of instant-access digital downloads are final once access or the download has been provided, except where applicable law requires otherwise.

One-Time Services

One-time services are subject to the cancellation and refund terms presented for that service.

1:1 Sessions

Unless different terms are presented when booking, the scheduling, rescheduling, cancellation, and no-show provisions in Section 3(g) apply.

Career Change Accelerator

Career Change Accelerator purchases are also subject to any program-specific refund, payment-plan, and cancellation terms presented before purchase.

Installment Plans

Stopping use of a product does not cancel an installment payment obligation unless the applicable product terms or applicable law provide a cancellation right.

Subscriptions

If a subscription is offered, cancellation prevents future renewals according to the applicable subscription terms. Amounts already charged are generally non-refundable unless otherwise stated or required by law.

Nothing in these Terms eliminates a refund, cancellation, chargeback, withdrawal, or consumer-protection right that cannot legally be waived.

Material refund or cancellation restrictions applicable to a purchase will also be disclosed as required in connection with the applicable offer or checkout.


8. Career, Employment, Educational, and AI Disclaimers

Elevated Careers provides educational and career-development information.

We do not guarantee any particular employment or career outcome.

Use of the Services does not guarantee:

  • an interview;

  • a job offer;

  • recruiter interest;

  • employment;

  • a particular salary;

  • a salary increase;

  • a promotion;

  • acceptance into a particular profession;

  • success in a hiring process;

  • success in a particular career;

  • continued employment; or

  • any specific financial or professional result.

Hiring outcomes depend on many factors outside Elevated Careers' control, including employer decisions, market conditions, candidate qualifications, timing, geography, competition, compensation requirements, hiring processes, and individual circumstances.

Career information changes over time.

Salary information, job postings, company information, job descriptions, qualifications, hiring requirements, remote-work arrangements, and other employment information should be independently verified before you rely on it.

Elevated Careers does not make hiring decisions on behalf of third-party employers unless expressly stated in connection with a specific service.

Nothing provided through the Services constitutes legal, tax, financial, investment, medical, mental-health, or other licensed professional advice.

Artificial Intelligence Tools

Some Services include prompts, examples, exercises, or instructions designed for use with third-party artificial intelligence tools.

Use of third-party AI tools is optional unless a particular Service expressly states otherwise.

AI-generated information can be incomplete, inaccurate, outdated, fabricated, inappropriate, or inconsistent with your experience.

You are responsible for reviewing, fact-checking, editing, and approving anything generated with an AI tool before using it.

You remain responsible for the truthfulness and integrity of resumes, cover letters, LinkedIn profiles, applications, interview responses, portfolios, professional communications, and other materials you submit or publish.

Do not submit confidential, proprietary, legally protected, or sensitive information to a third-party AI provider unless you have determined that doing so is appropriate.

Elevated Careers does not control third-party AI providers, their models, outputs, availability, security, data retention, or privacy practices.


9. Intellectual Property and Your License to Use Elevated Careers Materials

The Site and Services contain materials owned by or licensed to Elevated Careers, including text, videos, course materials, methodologies, frameworks, worksheets, guides, workbooks, templates, prompts, trackers, databases, graphics, branding, logos, designs, downloads, software, and other content ("Elevated Careers Materials").

Elevated Careers Materials are protected by copyright, trademark, trade-secret, and other applicable intellectual-property laws.

Unless a product expressly states otherwise, purchasing or receiving access to Elevated Careers Materials gives you a limited, personal, non-exclusive, non-transferable, revocable license to use those materials for your own non-commercial career-development purposes.

Ownership is not transferred to you.

You may download or print materials where the applicable Service permits it.

You may not, without prior written permission from Elevated Careers:

  • sell or resell Elevated Careers Materials;

  • share paid materials with another person who has not purchased or been authorized to receive them;

  • upload paid materials to a public website, shared drive, database, course platform, online community, or file-sharing service;

  • reproduce or distribute substantial portions of Elevated Careers Materials;

  • republish the materials;

  • modify the materials to create a competing commercial product or service;

  • use the materials to train, develop, or create a competing commercial AI system, product, course, database, or service;

  • remove copyright, trademark, attribution, or proprietary notices;

  • scrape, crawl, systematically download, or extract Elevated Careers Materials;

  • reverse engineer software or proprietary tools;

  • sell access to an Elevated Careers account; or

  • otherwise commercially exploit Elevated Careers Materials.

Where an Elevated Careers resource specifically instructs you to paste a prompt, job description, exercise response, or other designated material into an AI tool for your personal use, doing so in accordance with those instructions does not violate this section.

All rights not expressly granted are reserved by Elevated Careers.


10. Third-Party Services, Websites, Job Postings, and Tools

The Services may link to, reference, integrate with, or rely on third-party websites, companies, job boards, employers, payment providers, email providers, quiz platforms, AI providers, social networks, or software services.

Elevated Careers does not control those third parties.

A link, reference, or inclusion does not guarantee or represent that Elevated Careers endorses the third party, its products, its employment practices, or every statement appearing on its website.

Third-party websites and services are governed by their own terms, policies, and practices.

You are responsible for reviewing those terms before providing information or using a third-party service.

Job postings can expire, change, be paused, be filled, contain errors, or be removed without notice.

Elevated Careers does not guarantee the continued availability, accuracy, legitimacy, compensation, location, or hiring status of a third-party job posting.

You should independently evaluate employers and opportunities before applying, interviewing, accepting employment, providing sensitive information, or making financial or career decisions.


11. Binding Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO HAVE CERTAIN DISPUTES DECIDED BY A COURT OR JURY.

(a) Informal Resolution First

Before initiating arbitration, you and Elevated Careers agree to make a reasonable good-faith effort to resolve the dispute informally.

A party seeking to raise a dispute should provide written notice describing the nature of the dispute and the relief requested.

Notices to Elevated Careers may be sent to [email protected].

The parties will have at least thirty (30) days after receipt of the notice to attempt informal resolution before arbitration is initiated, unless waiting would cause a claim to expire or immediate relief is otherwise legally necessary.

(b) Agreement to Arbitrate

Except for the matters specifically excluded below, you and Elevated Careers agree that disputes, claims, or controversies arising out of or relating to these Terms, the Site, the Services, or your relationship with Elevated Careers will be resolved through binding individual arbitration rather than in court.

This agreement to arbitrate is intended to be governed by the Federal Arbitration Act.

(c) Exceptions

Nothing in this section prevents either party from:

  1. bringing an eligible individual claim in small claims court;

  2. seeking temporary or preliminary injunctive relief in a court when necessary to protect intellectual-property, confidentiality, security, or similar rights while arbitration is pending;

  3. reporting a matter to a federal, state, local, or other governmental agency; or

  4. pursuing a claim that applicable law does not permit to be arbitrated.

(d) Arbitration Administrator and Rules

Arbitration will be administered by JAMS under the rules applicable to the dispute, including its Consumer Arbitration Minimum Standards when applicable.

The arbitrator will have authority to determine issues properly submitted to arbitration and may award any individual remedy or relief that would otherwise be available under applicable law.

Arbitration may occur by video conference, telephone, written submissions, or at a reasonably convenient location consistent with applicable JAMS rules and standards.

Consumer arbitration fees will be allocated in accordance with applicable JAMS rules and minimum standards.

(e) Individual Proceedings Only

To the fullest extent permitted by law, arbitration will occur only on an individual basis.

YOU AND ELEVATED CAREERS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLASS MEMBER, OR REPRESENTATIVE IN A PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION.

Unless both parties expressly agree otherwise, the arbitrator may not consolidate the claims of more than one person or preside over a class, collective, or representative proceeding.

(f) Jury Trial

For disputes subject to arbitration, you and Elevated Careers knowingly waive the right to have the dispute decided by a judge or jury in court.

(g) Severability

If any portion of this arbitration section is found unenforceable, that portion will be severed or limited to the minimum extent necessary while the remainder will remain in effect, except where applicable law requires a different result.

If the class-action waiver is finally determined to be unenforceable as to a particular claim or request for relief, that claim or request for relief will proceed in a court of competent jurisdiction to the extent required by law, while arbitrable individual claims may remain subject to arbitration.


12. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE, SERVICES, ELEVATED CAREERS MATERIALS, INFORMATION, PRODUCTS, SOFTWARE, TOOLS, JOB RESOURCES, QUIZ RESULTS, DIGITAL PRODUCTS, AND OTHER CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE."

ELEVATED CAREERS DISCLAIMS WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE EXTENT THOSE WARRANTIES MAY LEGALLY BE DISCLAIMED.

ELEVATED CAREERS DOES NOT WARRANT THAT:

  • THE SERVICES WILL ALWAYS BE AVAILABLE OR UNINTERRUPTED;

  • THE SERVICES WILL BE FREE FROM ERRORS, DEFECTS, VIRUSES, OR OTHER HARMFUL COMPONENTS;

  • ANY PARTICULAR CAREER OR EMPLOYMENT RESULT WILL OCCUR;

  • INFORMATION WILL ALWAYS BE COMPLETE, CURRENT, OR ERROR-FREE;

  • A THIRD-PARTY SERVICE OR LINK WILL REMAIN AVAILABLE; OR

  • THE SERVICES WILL MEET EVERY USER'S INDIVIDUAL NEEDS.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS. IN THOSE JURISDICTIONS, THESE DISCLAIMERS APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.


13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ELEVATED CAREERS AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO THE SITE, SERVICES, MATERIALS, PRODUCTS, OR THESE TERMS, INCLUDING LOSS OF INCOME, EMPLOYMENT OPPORTUNITY, BUSINESS OPPORTUNITY, DATA, PROFITS, OR GOODWILL.

TO THE FULLEST EXTENT PERMITTED BY LAW, ELEVATED CAREERS' TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

  1. THE AMOUNT YOU PAID DIRECTLY TO ELEVATED CAREERS FOR THE SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR

  2. ONE HUNDRED U.S. DOLLARS (US $100).

These limitations do not apply to liability that cannot lawfully be excluded or limited.


14. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Elevated Careers and its members, officers, employees, contractors, agents, and affiliates from claims, liabilities, damages, losses, and reasonable costs arising from:

  • your material violation of these Terms;

  • your unlawful use of the Services;

  • User Content you submit that infringes or violates a third party's rights;

  • your fraudulent or unauthorized conduct; or

  • your misuse of another person's account, information, or intellectual property.

Elevated Careers reserves the right to control the defense of a matter subject to indemnification, and you agree to reasonably cooperate in that defense.

This section does not require a consumer to indemnify Elevated Careers for Elevated Careers' own unlawful conduct where such an obligation would be prohibited by law.


15. Acceptable Use

You may use the Services only for lawful purposes and in accordance with these Terms.

You may not:

  • violate applicable law or regulation;

  • infringe another person's intellectual-property, privacy, publicity, contractual, or other rights;

  • impersonate another person or misrepresent your identity;

  • provide materially false information;

  • share access to paid individual Services without authorization;

  • attempt to bypass access controls or payment requirements;

  • interfere with the security or operation of the Site or Services;

  • introduce malware, malicious code, or other harmful technology;

  • scrape, crawl, harvest, copy, or systematically extract content or data from the Services without permission;

  • use automated tools to overwhelm or interfere with the Services;

  • reverse engineer proprietary software except where applicable law expressly permits it;

  • use Elevated Careers Materials to create or operate a competing commercial product or service without written permission;

  • resell, sublicense, or commercially redistribute the Services;

  • collect personal information about other users without authorization;

  • submit confidential third-party information you do not have a right to provide;

  • engage in harassment, threats, abuse, fraud, or unlawful conduct through the Services; or

  • assist another person in doing any of the above.

Elevated Careers may investigate suspected violations and may suspend or terminate access when reasonably necessary to protect the Services, Elevated Careers, other users, or third parties.

We may cooperate with lawful governmental requests, subpoenas, court orders, or investigations as required or permitted by law.


16. Account Suspension, Termination, and Data Deletion

You may request closure or deletion of your account or personal information as described in our Privacy Policy and through any account controls we make available.

Deleting an account does not automatically require deletion of information that Elevated Careers is legally permitted or required to retain, such as transaction records, fraud-prevention records, legal records, or information needed to establish, exercise, or defend legal claims.

Information may also remain in secure backups for a limited period before deletion through normal backup cycles.

Elevated Careers may suspend or terminate access to the Services if you materially violate these Terms, fail to pay amounts properly due, misuse the Services, infringe intellectual property, compromise security, or engage in unlawful conduct.

Termination of access does not eliminate payment obligations that accrued before termination or provisions of these Terms that by their nature should survive termination.

Sections concerning payment obligations, intellectual property, disclaimers, liability, dispute resolution, indemnification, and other provisions intended to survive will remain effective after termination.


17. Feedback, Reviews, and Testimonials

If you voluntarily provide suggestions, ideas, product feedback, or recommendations to Elevated Careers, you grant us permission to use that feedback to improve or develop our products and Services without compensation or obligation to you.

This does not automatically authorize us to identify you publicly.

If you submit a review, testimonial, photograph, video, success story, or other content specifically for publication or expressly authorize us to publish it, you grant Elevated Careers a non-exclusive, worldwide, royalty-free license to reproduce, display, publish, format, and distribute that authorized content for marketing, educational, and promotional purposes, subject to any limitations agreed upon when permission is provided.

You may contact us if you wish to request that we stop using a testimonial prospectively. We will make reasonable efforts to honor such requests, although previously printed materials or content already distributed may not be retrievable.


18. International Users and Mandatory Consumer Rights

Elevated Careers is based in the United States.

Users outside the United States are responsible for determining whether the Services are appropriate and lawful to access in their jurisdiction.

Nothing in these Terms excludes, restricts, or waives a mandatory consumer right that applicable law does not permit you to waive.

Digital Content and Withdrawal Rights

Consumers in certain jurisdictions may have statutory cancellation or withdrawal rights.

Where applicable law requires prior express consent before immediate delivery of paid digital content can begin during a statutory withdrawal period, Elevated Careers may request that consent at or before checkout.

Where applicable, by expressly requesting immediate access and acknowledging the applicable consequence before digital delivery begins, you may lose a statutory right to withdraw once performance begins, to the extent permitted by applicable law.

Merely stating a general no-refund policy does not eliminate a mandatory right that applicable law gives you.

If mandatory local consumer law conflicts with these Terms, that mandatory law controls to the extent of the conflict.


19. Global Access Pricing

Elevated Careers may offer Global Access Pricing for certain products in eligible international markets.

Global Access Pricing is intended to account for differences in regional purchasing power and market conditions.

Eligibility may be determined using the country of residence or other location information provided by the customer or prospective customer.

Eligibility criteria, participating markets, prices, and pricing methods may change for future purchases.

Unless expressly stated otherwise, Global Access Pricing provides access to the same applicable product rather than a reduced or limited version.

Global Access Codes

Elevated Careers may provide an eligible customer with an individual promotional or coupon code that adjusts the standard purchase price.

Global Access codes may be subject to expiration dates, redemption limits, product restrictions, geographic restrictions, or other conditions disclosed with the offer.

Unless expressly authorized by Elevated Careers, Global Access codes may not be sold, published, distributed, transferred, or intentionally shared for another person's use.

Global Access Pricing may not be combined with other discounts or promotional offers unless Elevated Careers states otherwise.

You agree to provide accurate information when requesting or using Global Access Pricing.

You may not intentionally misrepresent your location, use another person's information, or circumvent eligibility requirements.

If Elevated Careers reasonably determines that a Global Access code was obtained or used through materially inaccurate information, unauthorized sharing, fraud, technical error, or intentional circumvention, we may decline the transaction, deactivate an unused code, cancel an improperly obtained discount, or take other reasonable action permitted by law.

Pricing Changes

Global Access Pricing, eligibility criteria, and available markets may change or be discontinued for future purchases.

A later change does not create a right to a refund, retroactive discount, credit, or price adjustment for a completed purchase, except where required by law.

The price presented and accepted at checkout is the price applicable to that transaction, subject to applicable taxes, fees, correction of genuine pricing errors, and mandatory legal rights.

Currency, Taxes, and Third-Party Charges

Unless stated otherwise, prices are quoted in U.S. dollars.

Customers may be responsible for applicable VAT, GST, sales tax, duties, or similar charges as required by law.

Banks and payment providers may impose currency-conversion or foreign-transaction fees that Elevated Careers does not control.

International Availability

Products, Services, promotional offers, and Global Access Pricing may not be available in every country, territory, or jurisdiction.

Elevated Careers may restrict, decline, or cancel transactions where reasonably necessary to comply with applicable law, economic sanctions, trade restrictions, tax requirements, payment-provider rules, fraud-prevention measures, or other legal obligations.


20. Governing Law

Except as otherwise required by applicable law and subject to Section 11 regarding arbitration, these Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law principles.

The Federal Arbitration Act governs the interpretation and enforcement of the agreement to arbitrate in Section 11.

Mandatory consumer-protection laws that cannot legally be waived remain applicable where required.

For any dispute that is not subject to arbitration and is not properly brought in small claims court, the parties consent to the jurisdiction of courts with lawful jurisdiction over the dispute, subject to any mandatory venue rights provided by applicable law.

Elevated Careers may update these Terms from time to time.

When we update them, we will revise the "Last Updated" date at the top of this page.

Where applicable law requires additional notice of a material change, we will provide that notice in the legally required manner.

Changes apply prospectively from their effective date unless otherwise stated or legally permitted.

Your continued use of the Services after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.

If you do not agree with updated Terms, you should stop using the Services.

A change to these Terms does not retroactively alter a completed purchase in a manner prohibited by applicable law.

By using the Services or providing an email address, you consent to receive transactional electronic communications relating to your purchases, account, access, appointments, support requests, legal notices, security, and administration of the Services.

Unsubscribing from marketing emails does not prevent us from sending non-marketing messages reasonably necessary to administer a purchase, account, appointment, legal notice, or Service you requested.


24. General Terms

Entire Agreement

These Terms, our Privacy Policy, and any applicable Additional Terms constitute the agreement between you and Elevated Careers regarding the applicable Services and supersede prior understandings concerning those Services.

Severability

If any provision of these Terms is held invalid, illegal, or unenforceable, the provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in effect, except where these Terms expressly provide otherwise.

No Waiver

Failure by Elevated Careers to enforce a provision of these Terms does not waive our right to enforce that provision later.

Assignment

Elevated Careers may assign or transfer its rights and obligations under these Terms in connection with a merger, acquisition, sale of assets, corporate restructuring, or other lawful business transaction.

You may not assign your rights or obligations under these Terms without our prior written consent except where applicable law provides otherwise.

No Partnership or Employment Relationship

These Terms do not create a partnership, joint venture, agency, franchise, fiduciary, employer-employee, recruiter-candidate, or other relationship beyond the contractual relationship expressly created by the Services.

Headings

Section headings are provided for convenience and do not alter the meaning of these Terms.

Reservation of Rights

Any right not expressly granted to you in these Terms is reserved by Elevated Careers.
